Intra-Company Transferees is a suitable option to transfer qualified employees of a company from any country to a branch of the same company in Canada. The branch can be described as a parent, a subsidiary, a branch, or an affiliate of the same enterprise. The employees being transferred do not need LMIA; but only the work permit. The initial work permit can be valid for a reasonable amount of time ranging from 18 months to 2 years which can be renewed for a maximum of 7 years for executive positions and 5 years for specialized knowledge position by showing proof of company operations. The employees being transferred must be holding an executive, senior managerial position, or possess specialized knowledge. The employees must be employed in the same position as they will assume in Canada for at least one year in the last three years in the branch outside Canada.
The most beneficial aspect of this program is that it considers start-up companies as well. The only requirements for start- up companies are that they must have secured a physical premises and have a realistic business plan which gives the immigration officer confidence that the company will operate. Of course, sufficient financial resources must also be demonstrated.
